1. What happens after I file an application?: Based on the information in the application to the Zoning Board of Appeals (ZBA), a legal notice is submitted to The Cape Cod Times. Hearing notifications are mailed to abutters. Plans and other materials are made available, so that the public can search properties by street address to view materials submitted to the ZBA. Paper copies of application materials are provided to Board Members, so they can review the information prior to and during the hearing.

2. I received a hearing notification. What should I do?: You do not need to reply to the hearing notification. You may choose to send comments in support or in opposition via letter (ATTN ZBA, Town of Yarmouth, 1146 Route 28, South Yarmouth, MA 02664) or email to the Zoning Board of Appeals Administrator: dfallon@yarmouth.ma.us It is helpful to include the property address and petition number listed on the hearing notification. If you attend the hearing, you can provide your comments at the hearing. The Board considers these comments in rendering their decision. Prior to the hearing, you can view the information filed at the Zoning Board of Appeals office (lower level of Town Hall, Monday-Friday, 8:30am-4:30pm) or you can find the plan or additional materials on Laserfiche by street address.

3. What happens at the public hearing?: For each petition, the Board Chair reads the agenda item into the record. The petitioner and/or their representative is asked to identify themselves for the record and make their presentation to the Board. The Board asks questions of the petitioner. The Board Chair asks if any audience members wish to speak. Correspondence received about the petition is admitted into the record. Then, the Board Chair closes the public input portion of the hearing. The Board discusses and deliberates the request. The petitioner may choose to withdraw part or all of the petition prior to the Board's vote. If necessary, the petition can be continued to a future hearing and a decision can be made at a later date. Otherwise, a decision is made at the hearing. The Board may place conditions on the granting of a Special Permit and/or Variance.

4. What happens after the Board reaches a decision?: The Board Chair or the petitioner's representative (i.e., attorney) drafts the decision. The decision is reviewed/approved by the Board Chair, then filed with the Town Clerk. Decision notification postcards are mailed to abutters. Any person aggrieved by the decision has 20 days (including weekends and holidays) from the date the decision is filed with the Town Clerk to appeal the decision. After the 20-day appeal period, the Town Clerk certifies the decision. The applicant is notified that the certified decision is ready for pickup. The applicant records the decision at the Barnstable County Registry of Deeds. The applicant returns a copy of the recorded decision to the Zoning Board of Appeals Office and the Building Department (lower level of Town Hall, Monday-Friday, 8:30am-4:30pm). The Building Department may not issue a building permit or occupancy permit without receiving a copy of the recorded decision.

5. What if I'm not happy with the Board's decision?: Within 20 days of the filing date of the decision, you may appeal the decision at Barnstable County Superior Court or Land Court in Boston and must provide a copy of the complaint to the Yarmouth Town Clerk (so the Town Clerk knows that the decision should not be certified). Appeals procedures are outlined in M.G.L. Ch. 40A §17.

6. What's the difference between a Special Permit and a Variance?: A Special Permit is required generally if your structure is non-conforming and you wish to make an alteration or extension to it. The Board of Appeals approval or special exceptions shall not be granted unless the applicant demonstrates that "no undue nuisance, hazard, or congestion will be created and that there will be no substantial harm to the established or future character of the neighborhood nor of the town". A Variance is required if you want to do something with your property which is generally prohibited by the Zoning Bylaw. The applicant must show a hardship imposed by the bylaw which is caused by a unique condition of the lot, or structure, and the hardship is owing to circumstances relating to the soil conditions, shape or topography of the land or structure and especially affecting the land or structures, but not affecting generally the zoning district in which it is located. Relief may be granted without substantial detriment to the public good, and without nullifying or substantially derogating from the intent or purpose of such ordinance or bylaw.

7. Why do I need a Special Permit or Variance?: The most common reason why you need a Special Permit is that the proposed structure or altered structure does not meet setback requirements in the Zoning Bylaw. So, you may need "relief from the bylaw" in the form of a Special Permit or Variance. Typically, the Building Commissioner refers you to the Zoning Board of Appeals when you apply for a building permit. 8. How long does it take to get a Special Permit or Variance?: The appeal process depends on the project. You may need approval from other boards and committees prior to a Zoning Board of Appeals hearing. 3. I want to add a bedroom/addition to my house. What is required?: The Health Department, through our office records, will help you determine if your existing septic system is large enough to accommodate your proposed renovations, in addition to meeting the required setbacks. Our office will also determine if your house lot is located within the Town of Yarmouth Zone II Areas of Wellhead Contribution. In general, properties located within this Zone II are limited to 1 bedroom per 10,000 square feet of land area. For example, a vacant lot of 20,000 square feet that is located within the Zone II is limited to 2 bedrooms with the installation of a standard Title V septic system. If your existing house and lot do not meet the minimum standard, you may be required to record a Deed Restriction on your property deed, which limits the total number of bedrooms, at the Barnstable County Registry of Deeds. Don’t forget to check with the Building Department at (508) 398-2231 ext. 261 to address any zoning issues.

4. My septic has failed; what do I do?: Contact a design engineer who will design a new septic system based on the total number of bedrooms for residential properties. The design of the septic system is a multi-step process that usually involves a survey of your property, a soil and percolation test, and a sketch of your house floor plan all of which can take up to 2- 3 months depending on your engineer’s schedule, the backlog of scheduled soil tests, and the review of the final septic plan by the Health Department. 6. When is a Building Permit required?: A Building Permit is required whenever a project includes construction, reconstruction, alterations, repair, removal or demolition of a structure. Also a permit is required for any change of use of a building or structure and /or the installation or alteration of any equipment that is regulated by the State Building Code.

7. Do I need a Plot Plan as part of my building application?: Yes, A Plot Plan is required if the proposed construction involves a new structure, an addition to an existing structure, or reconstruction.

8. How long are permits good for?: Any building permit issued shall be deemed abandoned and invalid unless the work authorized by it shall have commenced within six months after issuance.

9. What about the issuance of plumbing, gas or wiring permits?: These permits are only issued to Massachusetts licensed plumbing, gas fitters and electrical.

1. When are Real Estate tax bills due?: The Town of Yarmouth issues Real Estate and Personal Property bills annually. The first half is due approximately on November 1st and the 2nd half is due May 1st.

2. Can I pay less than the real estate tax due?: Yes, partial payments are accepted but each payment must be at least 10% of the original tax and interest will accrue @14% per annum on the balance. Partial payments are only accepted until the time of Tax Title Process begins.

3. Can I pay my tax bill by credit card?: On line eBILL (epay.cityhallsystems.com) is available with MC, Visa and Debit cards for Real Estate, Personal Property and Excise taxes.

4. Why is the former owner's name on my real estate tax bill?: The State mandates tax bills to be assessed to the owner of record as of January 1st prior to the new fiscal year of July 1st. It is very important to submit any ownership changes and mail address updates to the Assessor's Office in writing at the time of closing. It may take many months before the Town is notified from the Registry of Deeds of transfers. Taxes are adjusted at the closing between the buyer and seller.

5. How much are Municipal Lien Certificates?: The cost of an MLC is $40.00 per parcel. More...

6. Why doesn't my exemption show on my real estate bill?: Exemptions are granted by the Board of Assessor's based on State guidelines for qualified elderly, veterans and blind, therefore, applications must be filed each tax year. Please check with the Assessor's Office for more information.

7. Can you correct my mailing address on my car excise bill?: The Town of Yarmouth cannot change these addresses. You need to notify the Registry of Motor Vehicles and your insurance company of any address change immediately. If you do not receive an excise bill, please contact this office @508-398-2231 Ext. 233.

8. Why is my tax payment sent to a Reading P.O. Box?: We have a Bank Lock Box Center in Reading, therefore, tax bill payments will be sent to the Reading Post Office Box. Town of Yarmouth utilizes a lockbox service through Century Bank with its highly automated capabilities is less costly for the tax payers than hiring staff to manually type in payment receipts and make bank deposits. Mail sent on Cape with rare exceptions are sent off Cape for processing and distribution. The mail time is essentially the same going to either location.

Community Preservation

1. What is the Community Preservation Act (CPA)?: Community Preservation Act (CPA) legislation was designed to help Massachusetts towns and cities plan ahead for sustainable growth and provide funds to achieve their community preservation goals. The CPA (MGL. c. 44B) was enacted by state legislators in 2000 allowing any Town in the Commonwealth to adopt a property tax surcharge of up to 3%, the revenues from which and any matching state funds could be directed to community housing, historic resources, open space, and recreational projects.

2. When did Yarmouth adopt the CPA?: In January 2005, the Town of Yarmouth voters adopted the CPA with a 3% surcharge, and simultaneously withdrew from the Cape Cod Land Bank (CCLB).

3. What is the Community Preservation Committee?

The Yarmouth Community Preservation Committee (CPC) was created in April 2005.

The CPC consists of nine voting members. Seven members represent existing committees from the Affordable Housing Committee, Conservation Commission, Historical Commission, Open Space Committee, Planning Board, Recreation Commission, and the Yarmouth Housing Authority. The two remaining seats are citizen-at-large positions appointed by the Board of Selectmen.

The Committee reviews applications and makes recommendations to Town Meeting for funding for community housing, historic, open space, and recreation projects.

4. How may I obtain a CPA application?: The Community Preservation Act application is available online or at Town Hall in the Department of Community Development.

5. Who decides how to spend the revenue?: You decide! The legislative body of Yarmouth (Town Meeting) ultimately approves any CPA expenditures, based on the recommendations of the Community Preservation Committee.
The Committee is required to study the community preservation needs of the city or town, hold a public hearing, consult with relevant boards and committees and make recommendations to the legislative body for the expenditure of CPA funds. The legislative body may approve, reduce or reject the recommended appropriations, or it may reserve CPA funds for future projects.

6. When are applications due for the FY20 grant round?

Complete applications must be submitted by October 4, 2019 at 4:00 p.m. to be eligible for consideration at Annual Town Meeting 2020.

Twelve (12) copies and all accompanying documents must be hand-delivered or mailed to the Town Hall at the address below.

Applications not received by the deadline, may be eligible for consideration at a Special Town Meeting. Please note that Special Town Meetings are not a regular occurrence.

7. Are restrictions placed on properties which receive Community Preservation funds?: Most projects are subject to permanent deed restrictions that meets the requirements of M.G.L c. 44B §12 and M.G.L. c. 184 §23 to 31.
Types of restrictions may include affordable housing deed riders, historic preservation restrictions, and conservation restrictions. Restrictions run with the land in perpetuity and are enforced by a governing agency.

8. What constitutes "community housing"?: Housing for low to moderate income individuals and families, including low or moderate income seniors.
Moderate income is less than 100%, and low income is less than 80%, of U.S. HUD Area Wide Median Income.

9. What constitutes "historic resources"?: A building, structure, vessel, real property, document or artifact listed or eligible for listing on the State register of historic places or determined by the Yarmouth Historical Commission to be significant in the history, archeology, architecture or culture of Yarmouth.

10. What constitutes "open space"?: Land to protect existing and future wellfields, aquifers and recharge areas, watershed land, agricultural land, grassland, fields, forest land, fresh and salt water marshes, and other wetlands, ocean, river, stream, lake and pond frontage, beaches, dunes and other coastal lands, lands to protect scenic vistas, land for wildlife or nature preserve and land for recreational use.

11. What constitutes "recreational land"?: Land for active or passive recreational use including, but not limited to, the use of land for community gardens, trails, and noncommercial youth and adult sports, and the use of land as a park, playground or athletic field.
Does not include horse or dog racing or the use of land for a stadium, gymnasium or similar structure.

1. When does the Conservation Commission meet?: The Commission meets on the first and third Thursdays of each month.

2. Who needs to file with the Conservation Commission?: Anyone who wishes to perform work in or near a wetland area, river, stream, pond, dune, coastal bank, or beach, or within the flood zone.

3. Do I need an engineer or surveyor?: Depending on the project; you may need to consult with a registered engineer or surveyor. The Conservation Administrator can help you determine whether or not consultant services are necessary or required.

4. How long does it take to go through the permitting process?: Usually about a month, if everything is clear and understood. In some cases, it could be as short as two weeks.

5. Is there a penalty for not going along with the Conservation Commission's policies?: Yes. Fines may be imposed, and court action might be involved. After the fact filings could require engineered plans and other information requiring professional studies.

6. What's the best way to find out specific information about my lot , or whether my plans need Conservation Commission review?: Visit the Conservation Commission office, or make an appointment with the Conservation Administrator.

1. What is novel coronavirus?: The coronavirus is a newly identified virus that has developed into a pandemic around the world.

2. How does the COVID-19 spread?: COVID-19 spreads primary between people who are in close contact with one another. The virus is transmitted through respiratory droplets produced when an infected person coughs or sneezes

3. What are the symptoms and complications of COVID-19?: Current symptoms reported for patients with COVID-19 have included mild to severe respiratory illness with fever, cough, and difficulty breathing.

4. Should I wear a mask?: You need to wear a cloth face covering if you are caring for someone at home who is sick and not able to wear a mask. The CDC recommends wearing a cloth face covering in public places. The recommendation was made after considering recent studies that have shown individuals with the virus who lack symptoms can transmit the virus to others. It is critical to emphasize that the face covering does not replace social distancing, stay at home measures, and hand washing recommendations.

5. What should I do if someone in my household is quarantined?: If someone in your household has been quarantined at home, all contacts including household members and caregivers should monitor their own health and call their healthcare provider if develop symptoms suggestive of COVID-19 (e.g., fever, cough, shortness of breath).

6. Should I be concerned about pets?: To date, the CDC has not received any reports of pets becoming sick with COVID-19.

7. What should I do if I am developing the symptoms associated with COVID-19?: Call your healthcare provider or the MA Public Health Department 211 X26

8. Is there a treatment?: There is no specific antiviral treatment for COVID-19. People with COVID-19 should seek medical care to help relieve symptoms

9. Should I be tested for COVID-19?: The MA Department of Public Health has establishing the protocol of whom should be tested and how the testing will be conducted. Call your health Care provider or call the MA Public Health Department 211 X26

10. Is there a vaccine?: There is currently no vaccine to protect against COVID-19. The best way to prevent infection is to avoid being exposed to the virus that causes COVID-19.

11. How can I protect myself?: Wash your hands frequently with soap and water for at least 20 seconds especially after you have been in a public space or after blowing your nose, coughing or sneezing. If soap and water are not readily available, use a hand sanitizer that contains at least 60% alcohol. Cover all surfaces for your hands and rub them together until they feel dry. Avoiding touching your eyes, nose and mouth with unwashed hands. Clean and disinfect frequently touched surfaces such as doorknobs, light switches, countertops, handles, phones, keyboards, toilets, faucets and sinks. Staying home will reduce your risk of becoming sick.

12. Social Distancing: It is important that people maintain a Social Distance of 6 feet between you and other individuals.

13. How can I protect others?: Stay home if you are sick. Use the inside of your elbow to cover coughs and sneezes. Wear a mask if you are sick and are around other people. Clean and disinfect frequently touched surfaces such as doorknobs, light switches, countertops, handles, phones, keyboards, toilets, faucets and sinks

14. What is the risk of my child becoming sick with COVID-19?: Based on available evidence, children do not appear to be at higher risk for COVID-19 than adults. While some children and infants have been sick with COVID-19, adults make up most of the known cases to date.

15. Is it okay for me to donate blood?: In healthcare settings all across the United States, donated blood is a lifesaving, essential part of caring for patients. The need for donated blood is constant, and blood centers are open and in urgent need of donations. CDC encourages people who are well to continue to donate blood if they are able, even if they are practicing social distancing because of COVID-19. CDC is supporting blood centers by providing recommendations that will keep donors and staff safe. Examples of these recommendations include spacing donor chairs 6 feet apart, thoroughly adhering to environmental cleaning practices, and encouraging donors to make donation appointments ahead of time.

16. Can the virus that causes COVID-19 be spread through food included refrigerated or frozen food?

Coronaviruses are generally thought to be spread from person-to-person through respiratory droplets. Currently there is no evidence to support transmission of COVID-19 associated with food. Before preparing or eating food it is important to always wash your hands with soap and water for 20 seconds for general food safety. Throughout the day wash your hands after blowing your nose, coughing or sneezing, or going to the bathroom.

It may be possible that a person can get COVID-19 by touching a surface or object that has the virus on it and then touching their own mouth, nose, or possibly their eyes, but this is not thought to be the main way the virus spreads.

In general, because of poor survivability of these coronaviruses on surfaces, there is likely very low risk of spread from food products or packaging that are shipped over a period of days or weeks at ambient, refrigerated, or frozen temperatures

17. Who is at higher risk for serious illness form COVID-19?

Older adults and people of any age who have serious underlying medical conditions may be at higher risk for more serious complications from COVID-19. These people who may be at higher risk of getting very sick from this illness, includes:

· Older adults

· Any person with a weakened immune system

· People who have serious underlying medical conditions like:

· Heart disease

· Diabetes

· Lung disease

18. Should I use soap and water or hand-sanitizer to protect against COVID-19?: Hand washing is one of the best ways to protect yourself and your family from getting sick. Wash your hands often with soap and water for at least 20 seconds, especially after blowing your nose, coughing, or sneezing, going to the bathroom, and before eating or preparing food. If soap and water are not readily available, use an alcohol-based hand sanitizer with at least 60% alcohol

19. How long does the virus stay alive on surfaces?: A recent study shows that COVID-19 is detectable for around 2-3 days on plastic and stainless steel, 24 hours on cardboard and 4 hours on copper.

1. How do I determine within what Flood Zone my property is located?: The Federal Emergency Management Agency (FEMA) has prepared Flood Insurance Rate Maps (FIRMs) that generally show flood zones throughout the Town. If you are required to provide a flood zone certification to your insurance company then it is your responsibility to hire a Professional Land Surveyor or other qualified professional to make that certification. Copies of the FIRMs are available in the Engineering Division for viewing; however, we do not provide certifications. To view FIRMs, click here.

2. Where do I call to report a road drainage problem?: For a new problem, contact Richie Anctil in the Engineering Division at 508-398-2231, ext 255 or for maintenance or cleaning of an existing drainage system contact the Highway Division at 508-775-2516.

3. How do I get an existing sign replaced/repaired or request a new sign?: For street sign maintenance or replacement, contact the Highway Division at 508-775-2516. For new signs, submit a completed Sign Request form and sketch to the Engineering Division. The Street Sign Committee meets monthly to review all new street sign requests. 4. 5. Who do I contact to report a road problem on Routes 6, 6A or 28?: Routes 6, 6A, and 28 are State owned and maintained roads; therefore, you call Massachusetts Highway Department’s Taunton Offices at 1-800-635-3590 to report a problem on those roads. To report a problem with a sidewalk only on Routes 6A and 28, call the Yarmouth Highway Division at 508-775-2516.

6. How do I obtain a Road Opening Permit on a Town road?: Excavations within Town road layouts require permits that are issued through the Engineering Division. Any area within the town layout (right of way) that is dug requires a permit from the Town. As always, DIG-SAFE and the Water Division should also be contacted to assure a safe work site. 7. Why does the Town seal many residential streets with stone chips rather that with black asphalt?: Chips sealing a road has been found to be the most cost-effective method to maintain local neighborhood road surfaces. The average cost to fix drainage, patch, crackfill, and chip seal a road is $40,000 per mile of road. Whereas, the cost of an asphalt overlay with a smooth black finish is 4 to 5 times greater than that for chip sealing. 8. What is the “Phase II Stormwater Program” that has been mentioned at public meetings?: In 2003, the EPA promulgated the so-called “Phase II Stormwater Regulations” under the National Pollution Discharge Elimination System (NPDES). The Engineering Division prepared and filed a Notice of Intent (NOI) in order to meet these new EPA regulations. Yarmouth’s Phase II Stormwater Management Program outlines how the town proposes to address the following six (6) Minimum Control Measures through the use of Best Management Practices (BMPs) over the next five (5) years: 1. Public Education and Outreach on Stormwater Impacts; 2. Public Participation and Involvement; 3. Illicit Discharge Detection and Elimination; 4. Construction Site Stormwater Runoff Control; 5. Post Construction Stormwater Management in New Development/Redevelopment, and 6. Pollution Prevention/Good Housekeeping for Municipal Operations.

9. What are those black lines in the road?: As part of the Town’s Roadway (Pavement) Management Program, the Town fills cracks in the roads with a bituminous asphaltic material in order to extend the life of our roads. Filling cracks seals the pavement surface so that stormwater can not enter the road structure which if allowed would cause premature pavement failure during the annual freeze-thaw cycles.

1. How is land developed?: With the help of Planning staff, the Planning Board regulates the creation of all residential and commercial subdivisions. Plans are submitted to the Board for their review, approval, and endorsement. The Board maintains a set of written standards for the design and construction of new roads and the placement of services that developers must follow.

2. What is the difference between a subdivision and an Approval Not Required (ANR) plan?: A subdivision involves the division of land into two or more lots and generally, involves the creation of a private road. An ANR plan is the division of land into lots with frontage on existing roads, whether those roads are public or private. Since the latter type of development does not create new roads, endorsement of an ANR plan by the Planning Board is a certification that Approval under the subdivision control law is Not Required.

3. Is my property in a floodplain?: Planning staff will help you determine whether your property lies in a floodplain, as designated by the Federal Emergency Management Agency (FEMA). The Planning office and the Engineering office have FEMA Flood Insurance Rate Maps for the entire town, which can be used to estimate where your property is and whether it is located within a floodplain.

4. What uses are allowed on my property?: Planning staff will review the zoning map and the Zoning Bylaw's Use Code with you to give you some idea of the possibilities. There is also a zoning map located on the wall outside the Planning office and on this website (see the link, above). Printed copies of the bylaw and map are available for purchase at the Permits counter. While we will to review applicable codes with you, please note that the Building Commissioner, as the Zoning Enforcement Officer, is the definitive zoning authority.

5. Is my lot buildable?: Only the Building Commissioner, who is also the Zoning Enforcement Officer, can make that determination. Forms to request a determination of buildability are available at the Building Division office.

6. Is my lot grandfathered?: This can be a complex question, and often requires a great deal of research to answer. Since the question deals with the buildability of a lot, Only the Zoning Enforcement Officer can answer the question with authority.

7. Can I subdivide my lot to create another lot?: Lot frontage and size are the primary factors in making this determination. Come to the office with this information for a more definitive answer.

8. How much will it cost to ....?: Please see our Fee Schedule for the particular action you wish the Planning Board to take.

9. Where can I get a copy of the Planning Board's Rules & Regulations Governing the Subdivision of Land , the Zoning Bylaw, or the Zoning Map?: All are available at the Permits counter on the lower level of Town Hall. 10. Do you have a plot plan for my property?: We do not. Certified plot plans, which are required when submitting applications to the Board of Appeals or when applying for certain building permits, must be prepared by a Registered Professional Land Surveyor.

11. Can you recommend a lawyer/surveyor?: Sorry, but no, we cannot. You might ask friends for their recommendations or look in the telephone directory for a list of names.

12. When does the Planning Board meet?: The Board holds a business meeting on the first and third Wednesday of each month.

13. How do I get an appointment to meet with the Planning Board to discuss a planning issue?: It's best to make your request in writing, but you might also call or drop by the Planning office with your verbal request. We try to put all requests to meet with the Board on the next available agenda. The deadline for getting on the next agenda is at 11:30 a.m. on the Friday before the meeting.

1. What can I do about annoying or harassing phone calls I have received?: If you are receiving annoying or harassing telephone calls, call the police department. Making such calls is against the law. An officer will speak with you and provide you with an "incident number" that your carrier will need. Call your carrier and request to speak with a representative from their Annoyance Call Bureau. Your phone carrier will give you detailed instructions on handling further calls and then will attempt to determine the origin of the calls. Once the location of the calls had been identified, the phone carrier will notify the Yarmouth Police and an officer will investigate the incident. How do I report a crime or suspicious activity?: If you think the incident is an emergency, dial 9-1-1 right away and report what you saw to the dispatcher, who will then send the appropriate response to investigate. 1. What is Title V?: The Massachusetts State Environmental Code, Title V is the regulation governing all septic systems in Massachusetts. The Department of Environmental Protection in conjunction with the local Board of Health, are responsible for enforcing the Title V Code. Title V was originally instituted in 1978 and was revised in 1995. In addition to Title V, the Yarmouth Board of Health, in 1978, promulgated the Town of Yarmouth Sewage Disposal Regulations which are more restrictive than Title V. In order to protect our drinking water and swimming beaches, it is important that all septic systems in Yarmouth conform to our local and state regulations.

2. My septic system has failed. What do I do?: Contact a design engineer who will design a new septic system based on the total number of bedrooms for residential properties. The design of the septic system is a multi-step process that usually involves a survey of your property, a soil and percolation test, and a sketch of your house floor plan all of which can take up to two to three months depending on your engineer’s schedule, the backlog of scheduled soil tests, and the review of the final septic plan by the Health Department. The Health Department is available to guide you through this process.

3. How often should I pump my septic system?: On average, every three to four years, depending on the use of the property. If your kitchen has a garbage disposal, your system should be pumped yearly.
Please note, make sure your septic system is designed for a garbage disposal.

4. I am selling my house. What is required?: According to the regulations of Title V, all septic systems must be inspected and certified prior to the sale of any property. Homeowners are required to hire a Massachusetts State Certified Inspector who is certified by the DEP to inspect and determine if your septic system meets the minimum standards. Most septic installers and engineers are certified to perform inspections. The septic inspector completes an inspection report with the details of the inspection. This report is provided to the homeowner and the Health Department who reviews the report and issues notices of correction, if warranted. In the event that a new septic system has been installed at the property within two years of the date of sale, an inspection would not be required, however, proof of the septic installation in the form of a Certificate of Compliance issued by the Health Department would be needed. There are certain exemptions from the inspection requirements, if the property is being transferred between family members i.e. between current spouses, between parents and their children, between full siblings, or between the grantor of a revocable or irrevocable trust where at least on of the beneficiaries is of a first degree relationship to the grantor. Please call the Health Department to determine if you qualify for an exemption.

5. I want to add a bedroom / addition to my house. What is requried?: The Health Department, through our office records, will help you determine if your existing septic system is large enough to accommodate your proposed renovations, in addition to meeting the required setbacks. Our office will also determine if your house lot is located within the Town of Yarmouth Zone II Areas of Wellhead Contribution. In general, properties located within this Zone II are limited to one bedroom per 10,000 square feet of land area. For example, a vacant lot of 20,000 square feet that is located within the Zone II is limited to two bedrooms with the installation of a standard Title V septic system. If your existing house and lot do not meet the minimum standard, you may be required to record a Deed Restriction on your property deed, which limits the total number of bedrooms, at the Barnstable County Registry of Deeds. Don’t forget to check with the Building Department to address any zoning issues.

6. I wish to landscape my yard. What do I need to know?: Prior to any landscaping or construction of any additions on your lot, check with the Health Department to determine the location of your septic system. Decks, sheds, and structures of any type cannot be built over the septic system components. These types of structures will prevent access to the septic components for required maintenance and repairs. Additionally, building structures may potentially damage the septic components leading to premature failure. Large plantings, such as trees and shrubs, will also potentially damage the system through excessive root growth that eventually clogs the system. Plants with shallow root systems, such as grass and ornamental flowers, are acceptable.

7. Is there a Tax Credit available for septic system installations?: Yes. In 1997, the legislature passed legislation allowing an income tax credit for septic system repairs for homeowners of residential properties. The total amount of tax credit allowed per tax year is $1500, although any excess credit amount may be applied in the three tax years following the first credit. More information may be obtained through your personal tax preparer or through the Massachusetts Department of Revenue.

8. Is there money available for septic pumping and/or replacement of my septic system?

Septic Pumping Reimbursement: This program, administered through the Health Department, provides low income families with monetary reimbursement for the cost of septic pumping. Residents must qualify, based on their total household income as established by the U.S. Department of Housing and Urban Development’s (HUD) Community Development Block Grant Program. If you are an employee and don’t live in the Town of Yarmouth and want to purchase a disposal sticker, you will need to buy the non-resident sticker at the full price.

The best way to purchase a discounted disposal sticker is to purchase the sticker on line at City Hall Systems.

9. When is the last day I can register to vote for the Presidential Primary?: February 12, 2020 is the last day you can register to vote in the Presidential Primary Election to be held on March 3, 2020.

14. Do I need to update my voter registration if I have moved residences?

15. How do I change my party affiliation?

If you would like to change your party affiliation, you will need to complete a Massachusetts Official Voter Registration Form. You can obtain the form by coming to Town Hall and completing the form accordingly.

You can also go online at https://www.sec.state.ma.us/OVR/ and change your party affiliation accordingly. Once complete, print and mail the form to Town Hall.

16. How do I obtain an absentee ballot?

If you would like an absentee ballot, you must request, in writing, by either the voter or the voter’s family member. For convenience, absentee ballot applications may be downloaded at Mass.gov. Please note that any written communication evidencing a desire for an absentee ballot is acceptable. If you would like to request an absentee ballot, you may submit an application or a signed letter to Town Hall. If you are requesting an absentee ballot for a family member, be sure to submit the request to the voter’s local election official.

When completing the application, you may indicate whether you are requesting a ballot for a specific election, or if you will be needing a ballot for all elections this year. Please note absentee ballot applications expire at the end of each calendar year.

Absentee ballot applications must be received by Town Hall by 12 p.m. on the day before the election.

Applications may be submitted in person, by mail, fax, or by e-mail; however, the local election official must be able to view the signature of the person requesting the ballot. If the application is being submitted by e-mail, a scanned copy of the request must be submitted.

17. Am I eligible to vote by absentee Ballot?

In order to be eligible to vote by absentee ballot in Massachusetts, a voter must be prevented from voting at their polling place on Election Day, due to:

Absence from the voter’s city or town on Election Day;
Or Physical disability; or
Religious belief.

18. How can I obtain an absentee voting application?

There are several ways to obtain an absentee voting application. The easiest way to obtain an application is to go to Mass.gov and down load the application itself. Here is the website: https://www.sec.state.ma.us/ele/elepdf/absentee/English-Absentee-Ballot-Application.pdf. Once you have completed the absentee ballot application, send the application to your Town Hall. You can send the application electronically by email as long as the requester’s signature is visible.

You can also come to Town Hall and pick up an absentee ballot application and complete it accordingly.

Finally, Town Hall can mail an absentee ballot application directly to you. For this service you will need to provide your address where you would like to receive the application. Please note, you must return the absentee ballot application promptly (to Town Hall) in order to receive an absentee ballot.

19. How can I register or pre-register to vote?

If you would like to register or pre-register to vote, you will need to complete a Massachusetts Official Voter Registration Form. You can obtain the form by coming to Town Hall and completing the form accordingly.

You can also go online at https://www.sec.state.ma.us/OVR/ and register accordingly. Once you complete the registration on line, print and mail the form to Town Hall.

20. What happens after I have determined my date and location of marriage?

Once you have determined a date and location of the marriage, you will need to pick up your marriage license. You will be given an envelope and an information document for the officiant. Please explain to the officiant the importance of the letter and that they will need to complete the bottom half of the marriage license once you are married.

A Special Note for a Solemnizers- If you are a Solemnizer, please ensure that you mail your solemnizer certificate along with the marriage license to Town Hall.

Once the marriage license is returned to the Town Hall, the Town Clerk will produce the marriage certificate and mail the certified marriage certificate to the couples address indicated on the applicable Address form.

21. Can the Town Clerks recommend a marriage officiant?: Yes, the Town Clerks have identified several individuals that are available to serve as your officiant. The Clerks are also happy to call an officiant on your behalf and arrange the date and time of the Marriage if you would like to have the marriage at Town Hall.

22. How do I purchase a Shellfish license?

Shellfish licenses can be purchased either on-line, via City Hall Systems, or at Town Hall, via the Town Clerk. The cost of the license is $30.00. If you are purchasing a shellfish license and are interested to purchase a beach and disposal sticker at the same time, the Town Clerk can process those transactions as well.

You must be a full time resident to purchase a shellfish license. You will need to provide one of the following to prove residence - a Yarmouth driver’s license, a utility bill, an excise tax bill, a mortgage statement etc. Finally, please be informed only one member of household can maintain a shellfish license at any given time.

If you prefer to mail in your shellfish application, you will need to complete the Disposal/Beach Permit and Shellfish Application. Once complete, please mail your Shellfish Application to City Hall Systems located at 3 Rosenfeld Drive, Hopedale, MA 01747.

Non-resident shellfish licenses are available for $80.00 for all non-residents.

If you are 75 and over, you can receive a discounted shellfish license. These can be purchased at Town Hall only. The cost is $15.00. You will need to provide your driver’s licenses to prove your age.

If you are veteran, have an honorable discharge card (DD214) and do not live in the Town of Yarmouth, you may purchase a resident shellfish license for $30.00.

23. My partner and I would like obtain a marriage license. What is required by the Town to be married in Yarmouth?

Congratulations. Your first step will be to come to Town Hall and visit the Town Clerk’s Office.

Per Massachusetts law, you must be at least 18 years of age to marry and not be married to someone else at the time of subsequent marriage.

You will be provided with a statement from The Commonwealth of Massachusetts – Legal Impediments to Marriage Document. This document will need to be read by both individuals who plan to marry.

There are several forms that will need to be completed by both parties planning to marry. Please remember when completing the forms it is essential the forms be completed in black ink, in print lettering and legible. You will be requested to complete the following forms:

Notice of Intention of Marriage Form – On this form you must write out your entire name including your middle name. It is also important to write out your parent’s full names and your mother’s maiden name. Please do not complete the bottom portion of the form until told do so by the Town Clerk.

Registry of Vital Records and Statistics Form – This form is capturing your social security number. If you do not have a social security number leave the field blank.

Marriage Worksheet – This worksheet captures the officiant’s name, marriage location and the date of the marriage.

Address Form - Complete the form with the address you would like to receive your marriage certificate.

On the Notice of Intention of Marriage Form, you will need to choose whether or not you would like to be Party A or Party B. Complete the remaining forms as the same Party you selected.

It is important to remember Massachusetts has a three day wait period before you can be married. The completed marriage intention form is only valid for 60 days. The Town Clerk will advise you of the 60 day marriage expiration date.

All forms must be completed at Town Hall and under no circumstance can the forms leave the premises of Town Hall.

Please be informed the cost of completing the marriage documents is $25.00 for the marriage intention forms and $10 for each certified marriage certificate.

Once the paperwork is complete, the Clerk will review the documents with both parties and ask clarifying questions if something is not clear.

If you are not sure of the date and location of the marriage and are unable to complete the marriage worksheet form, you will not be able to pick up the marriage license until you have determined a date and location of the marriage.

24. How do I renew and/or discontinue my business license?

You will need to visit the Town Clerk to renew and/or discontinue your business license. There is no form required to renew and/or discontinue your business license.

The cost to renew your business license is $30.00 and the cost to discontinue your business license is $15.00.

If you ever need to change the address on your business certificate you need to come to Town Hall. The cost is $15.00

25. How do I purchase a business license, if I have a new business in Yarmouth?

The New Business application is on the Town’s website located under the Clerks section. You can download the application, and complete the application accordingly. You can also come to Town Hall and pick up an application. The Town Clerks have the application.

Once complete, you must have the application approved by the Building Department at Town Hall.

Once the Building Department has approved the business license application, bring the application to the Town Clerk’s Office. The Town Clerk will create your business license and notarize the license. The cost of the business license is $30.00

Please be informed you may be required to either provide your social security number or a Tax Identification Number to complete the business license.

26. How do I obtain a parking pass for Dennis Pond?

The Town is continuing to offer Dennis Pond parking passes at no cost.

Please be advised that under the authority of Chapter 45, Section 5 of Massachusetts General Laws, the following rules and regulations concerning the pond were adopted by the Yarmouth Park Commissioners.

A separate pass will be required for each vehicle using the Dennis Pond Park area (only one sticker per family is allowed)
A pass shall be issued only to residents of the Town of Yarmouth who have children residing with them who are under the age of 16 years old. A birth certificate will need to be provided as proof of age.
Stickered vehicles may park at the beach parking area. Non-stickered vehicles will not be allowed to park in this designated area.

27. How do I purchase a dog license?

Dog licenses are sold by the Town of Yarmouth Clerk’s Office. In order to purchase the license, you must have a valid rabies certificate for your dog. The current cost of the license for a spayed or neutered dog is $10.00. If your dog is not spayed or neutered the cost of the license is $20.

As a dog owner, the Town will issue up to three dog licenses per household.

Please be advised if you have between four and six dogs, that need to be licensed, you will need to pay for each of the dog licenses as well as a multi-pet license. The price for the dog license remains the same as listed above. The multi-pet license is $60.00.

If you own a commercial dog kennel, you will be required to purchase a multi-pet license.

If you have more than six dogs, you are in violation of town by-laws and can be fined by the Town’s Dog Officer.

28. What if I don’t have my vehicle motor registration, can I still purchase a disposal and/or beach sticker?: If you cannot find your vehicle motor registration you can bring in your excise tax bill. This document has your license plate number.

29. Why is the disposal sticker so expensive?: The disposal sticker price has not increased in the last five years allowing residents to continue using this service without increased fees. The Town of Yarmouth’s disposal sticker price is significantly lower than other municipalities on the Cape. The current cost is $162.00

30. Why are disposal and beach stickers being processed at the Collector/Treasurers counter instead of the Town Clerk’s counter?: The Town would like to provide one stop shopping for certain purchases handled by the Finance Department. Transferring Beach and Disposal Sticker processing to the Collector/Treasurers’ Office was changed in hopes of improving customer services as you, the customer, can now pay your tax and/or utility invoices as well as purchase your beach and/or disposal stickers at the same service window.

31. What do I do if I am having a difficult time resolving a variety of issues related to my beach and/or disposal stickers?: If you are having multiple issues with your disposal and/or beach stickers, you can call the Town Clerk’s office. The phone number is 508-398-2231. They will do their very best to resolve your issue over the phone

32. Who do I contact if I have a complaint and/or a suggestion for the Town’s disposal and recycle area?: Town residents can call the Sanitation Superintendent, Roby Whitehouse, at 508-398-2231 x1215. To contact the Scale House call 508-398-2231 ext. 1632. They can resolve your issue accordingly.

33. I have not paid my tax and/or utility bill. Can I still obtain a disposal and/or beach sticker?

Please be informed neither the Treasure/Collector nor the Town Clerks will issue disposal and/or beach stickers when a town resident has outstanding tax and/or utility invoices. Once these invoices are paid in full, a disposal/beach sticker can be issued accordingly.

If you owe less than $1.00 on your outstanding tax and/or utility bill a town supervisor can allow the purchase of a disposal and/or beach sticker.

34. How do I purchase a Disposal Coupon Book?

Disposal coupon books are available at the Town Clerks Office. The book has 10 coupons and the cost is $100.00. These coupons are good for both the disposal and recycling area at the dump.

You can also purchase the coupon book at the kiosk located at the entrance of the dump.

35. Are there discounted Town of Yarmouth beach stickers for Veterans and/or for individuals with disabilities?

Yes, individuals with disabilities can purchase a handicap sticker. The cost of the sticker is a $1.00. You must provide a handicap placard, your motor vehicle registration, and proof of residency e.g. utility bill.

A resident veteran with an honorable discharge card, (DD214), can purchase a beach sticker for $28.00. You will need to provide your motor vehicle registration.

A veteran with a veteran’s plate can purchase a beach sticker for a $1.00. You must provide your motor vehicle registration as proof. See the list of acceptable plates here.

36. Are there discounted Town of Yarmouth disposal stickers for senior citizens and/or Veterans?: At this time, there is no discounted disposal stickers for senior citizens or for Veterans. Senior citizens and Veterans are required to purchase the full price disposal sticker. The cost is $162.00

37. What if I have a business owned vehicle. Can I obtain a disposal and/or beach sticker?

In order to obtain a disposal and/or beach sticker for your business owned car, you will need a letter from the business owner granting permission to use the vehicle for your own personal use.

You will also need your vehicle motor registration

38. I have a leased vehicle. How do I purchase disposal and beach stickers: In order to purchase a disposal and/or beach stickers you will need to bring in the front cover of your lease indicating your name as well as the Motor Vehicle Registration.

39. I am a town resident and I have rented a car for the summer. How do I get a resident disposal and/or beach sticker?: The Town Clerk’s Office will provide you with beach and disposal sticker letters. You must provide a copy of the lease associated with the vehicle. The letter (with the stickers attached) must be placed in your car accordingly.

40. How do I obtain a temporary beach sticker when my car is in the repair shop?: The Town Clerk’s Office will provide you a temporary beach sticker letter for a limited time (depending how long your car is in the repair shop). You must provide your driver’s license and you WILL be requested to provide proof that your car is in the repair shop. Once you are issued the temporary beach letter, you must place the letter in your car accordingly.

41. How do I obtain a temporary disposal sticker when my car is in the repair shop?

The Town Clerk’s Office will provide you a temporary disposal sticker letter for a limited time (depending how long your car is in the shop).

You must provide your driver’s license and you may be requested to provide proof your car is in the repair shop. Once you are issued the temporary disposal letter, you must place the letter in your car accordingly.

42. I am a new Trustee and I want to purchase a disposal and beach sticker for my car. What is required?

You must bring in your Trust and have it verified by the Town Clerk’s Office. Once confirmed, a disposal and beach sticker can be sold accordingly.

Please be informed if there are multiple people on the Trust, the Town can only provide up to 4 beach stickers per house hold.

43. I have an existing Trust and have been purchasing disposal and beach stickers for several years. What documentation is needed to purchase the stickers? – When an existing vehicle is involved.

The Town maintains an updated list of Trust and Trustees, if you are on the list, then no documentation is needed to obtain a disposal and beach sticker for your vehicle.

Please be informed if there are multiple people on the Trust, the Town can only provide up to 4 beach stickers per house hold.

44. I have a short term rental for the summer, how can I visit the beaches in Yarmouth?

As a short term renter, you are not eligible for a residential beach sticker. The beach kiosk sells daily ($20.00), weekly ($75.00) or monthly passes for entrances onto the beach area.

As an alternative, you can purchase a non-resident beach sticker for the summer season at a cost of $250.00.

45. I have an existing lease and have leased the same property for several years. How do I purchase a Disposal and Beach Sticker?: If you are an existing renter with a long history of leasing, a signed lease will not be required however you must present your vehicle registration to purchase the disposal and beach stickers.

46. I am a new year round renter, how do I purchase a Disposal and/or Beach Sticker.: If you are a new renter and would like to purchase the Town’s disposal and beach stickers, you must have a 12 month lease, and a copy of your vehicle registration. If your new leased address is not the same as what is listed on your vehicle registration, you will need to provide another form of documentation indicating the leased address e.g. an electric bill. If your lease is less than 12 months, you can purchase a non-resident dump sticker and a non-residential seasonal beach sticker. Non-residential seasonal beach stickers are only available at the beach gate house.

47. I have an existing lease with Davenport Properties, how do I purchase a Disposal and/or Beach Sticker?: If you are an existing renter with a long history of leasing, a signed lease will not be required, however you must present your vehicle registration to purchase disposal and beach stickers.

48. How do I purchase Beach & Disposal Stickers?

Would you like to purchase a beach or disposal sticker? If so, please see this informational document. The document directs you to the Town’s website where you can follow the instructions to purchase beach and disposal stickers online. Using the online service will allow you to save $5.00 on each sticker.

If you do not want to purchase the stickers online, you can complete a mail in application which is located on the informational document. Please mail your Disposal/Beach Permit and Shellfish Application to City Hall Systems located at 3 Rosenfeld Drive, Hopedale, MA 01747. This will also save you $5.00 per sticker.

You can also purchase full price stickers if you visit the Treasurer/Collector window at Yarmouth’s Town Hall located at 1146 Route 28, Yarmouth, MA 02664.

If you are unable to come in normal business hours during the week and would like to purchase your disposal and/or beach sticker Saturday and/or Sunday, you visit the Yarmouth Chamber of Commerce. The address of the Yarmouth Chamber of Commerce is 416 Rte 28, Yarmouth Port, MA 02673. Their phone number is 508-778-1008.

49. I have a new lease from Davenport Properties, how do I purchase a Disposal and/or Beach Sticker?

If you are a new renter with Davenport Properties and would like to purchase disposal and beach stickers, you will be requested to provide a new renter lease and your vehicle registration.

If your new leased address is not the same as what is listed on your vehicle registration, you will need to provide another form of documentation indicating the leased address e.g. an electric bill.

50. I live at Yarmouth Camp Ground Property or the Bass River Trailer Park site and I cannot find my property/site in City Hall Systems. What should I do?

The Town will confirm your property/site on the caretaker’s property/site list and will add your property/site information into the CHS system accordingly. If you are not on the caretaker’s property/site list you will be required to demonstrate ownership of the property/site by providing a deed to the Town Clerk. Once ownership is verified, the Town Clerk will put your property/site into the CHS System. Once your property/site is on CHS’s website, you can order your stickers online accordingly.

The property/site list is current as of December 2019.

51. How can I gain immediate access to the Town’s disposal and/or the Town’s beaches? Can a buy a sticker to gain immediate access?

Town and non-town residents can order disposal and beach stickers online through CHS. You can pay by credit card and use your receipt to access the disposal and beaches immediately.

Town and non-town residents can also pay the daily fee to use these services at any time.

If you are in Yarmouth, MA on a Saturday, you can purchase your beach/disposal stickers at the Chamber of Commerce at: 424 MA-28, West Yarmouth, MA 02673, Phone: (508) 778-1008.

52. What if I have completed my mail-in Disposal/Beach and Shellfish application and want Yarmouth Town Hall to issue my disposal/beach sticker at the $5.00 discounted rate?: The Treasure/Collectors nor the Town Clerks can process a CHS mail-in order form. The form has to be mailed in to receive the $5.00 discount. If you would like to have a disposal/beach sticker immediately, you can always purchase the stickers at their full price at Town Hall.

53. How long before I receive my sticker if I purchased the stickers online or mailed in the Disposal/Beach and Shellfish application to City Hall Systems (CHS)?

For online orders using an electronic check, it can take up to three weeks to receive your sticker. This is due to CHS posting the electronic check to your bank, CHS confirming the check has cleared, CHS’s own processing time to process the sticker, and the amount of time for the postal delivery.

For online orders using a credit card, it can take up to two weeks to receive your sticker. This is due to a three day waiting period by CHS to process the credit card and the amount of time for the postal delivery.

For mail-in orders, it can take more than three weeks. This is due to the amount of time for the postal delivery, the check clearing process and CHS’ transaction processing time.

As always, you can come to Yarmouth Town Hall, located at 1146 Route 28, Yarmouth MA to pay (in full) and pick up your stickers in the same day.

The Town recommends you submit your online and/or mail-in sticker orders timely and pay special attention to processing times.

If you purchased your disposal/beach sticker online and have a printed receipt indicating that you paid for the stickers, the dump and the resident beaches will honor the receipt and allow you access until such time your stickers arrive in the mail.

54. Why is it cheaper to purchase disposal and/or beach stickers online and/or by mail in the sticker application via City Hall Systems?: While the staff is very happy to serve our walk in customers, online and mail in purchases are cheaper because the online and mail-in option reduces the cost of processing these transactions at the Town Hall. If you come to Town Hall you will be charged the full prices of the stickers.

55. How do I get information about online and mail in purchases through City Hall Systems?

56. When are dog licenses due?: All dogs need to be registered by June 30th, after that date we will be collecting a late fee of $15.00 per dog.

57. Where can I get a birth or death certificate?: The Town Clerk’s office issues both birth and death certificates. If, at the time of the birth or death, the person is a town resident, we will have the information in this office.

58. How can I receive a dog license through the mail?: Please send us a copy of the current rabies certificate from your Veterinarian, along with a stamped self-address envelope, and a check made payable to the Town of Yarmouth in the amount of ten dollars ($10.00) for each spayed/neutered dog, or the amount of twenty dollars ($20.00) for each male/female.

59. How can I receive a shellfish permit through the mail?: A resident or taxpayer in the Town of Yarmouth may receive one shellfish license per address. Send your request with a copy of your Massachusetts license, a check in the amount of thirty dollars ($30.00) or fifteen dollars ($15.00) if you are seventy-five (75) or older, and a stamped self-address envelope.

2. What are voters being asked to approve in connection with wastewater?: Voters will be asked to approve the appropriation $207.2 million to construct Phase One of the Town’s sewer project, which includes pipe installation and building the Wastewater Treatment Plant.

3. Why is this project beneficial for all of Yarmouth?: The project’s purpose is to reduce nitrogen loading to rivers, bays, and harbors through the discontinued use of on-site septic systems in portions of Yarmouth. The treatment of the associated wastewater with enhanced nitrogen removal would remove a potential threat to drinking water quality, protect sensitive resource areas, shellfish and indigenous plant species decimated by accelerated growth of nuisance plants and algae, while simultaneously promoting revitalization of the Route 28 corridor and Yarmouth’s overall economy.

4. Is the sewer project being financed via property taxes like the 2011 proposal?: No. Multiple opportunities will make up the funding sources, including Cape &Islands Water Protection Trust, District Improvement Financing (Article 19), user capital fees, low or zero interest (0%) financing, state and federal grants and betterment charges.

5. What is the cost of doing nothing?: The cost of doing nothing would present regulatory ramifications, potential to third party lawsuits, effects on residential properties and business and tourism.

6. Once approved, when does work commence and when will Phase One be completed?: The Phase One projected start date is September 2023. Projected construction end date is June 2026.

7. What does approving this project do in relation to the new DEP septic regulations I’ve heard about?: The Town’s wastewater project (DEP approved) is the best step the Town can take to avoid property owners throughout town from having to upgrade existing Title 5 systems with expensive Innovative/Alternative (I/A) systems (soon to be required by the Department of Environmental Protection) which do little to reduce nitrogen into our environment.

9. How much is this going to cost me?: Voters will be asked to approve the appropriation of $207.2 million to construct Phase One of the Town’s sewer project. Most of Phase One is focused on commercial properties and the Route 28 corridor. There are 8 phases to the project. Every property that must connect will incur betterment, connection costs, and sewer charges.

10. What is a betterment fee and how does it impact my property?

A betterment fee calculates a fair proportion of the project costs to property owners within Phase One. Much of Phase One encompasses the Route 28 corridor, therefore much of the costs are borne by commercial properties (many are hotels and restaurants). Our project calculations show the following examples (all over 30 years):

A 50-room hotel will be $8,500 annually
A 50-seat restaurant will be $2,704.55 annually
A single-family home with up to three bedrooms will be $510 annually
A two-bedroom condominium is $340 annually

The town is limiting the betterments to 15% of the project costs. This lowers the obligation to property owners. This is possible because the Town is using available funding sources to help lower the betterments to property owners.

12. What do I do with my septic system after I connect?: The Board of Health has yet to determine, but you will likely be able to fill your septic system and leave it underground.

13. Will I be allowed an extra bedroom/additional flow if I connect to the sewer?: 725,000 gallons has been reserved for additional flow; how that may be allocated has yet to be determined.

14. When will I be able to connect?: Each phase will take approximately 5 years to complete.

15. Are there programs to help property owners pay for this?: For connection costs, Barnstable County has created a low-interest or no-interest loan called the AquiFund. The Cape Cod 5 has a sewer connection loan and other financial institutions have products to help you pay for sewer connection costs. The betterment fee to the town will be at a low interest rate and can be stretched over a 30-year period and is transferable with any sale of the property.

16. Will all of Yarmouth be connected to the sewer?: No, only the nitrogen sensitive areas of Bass River, Parkers River, and Lewis Bay area.

17. What happens if my septic fails and needs to be replaced before my property is in “its phase” or if I sell my property and it fails to pass Title 5 and I’m in a later phase?: The Health Department is prepared to work with property owners in these cases. This may involve more frequent septic tank pumping, or other significant system maintenance procedures. Property owners in future phases (after Phase One) will likely need some type of septic system repair to allow them to use their septic system until a sewer connection is available. This will be reviewed on a case-by-case basis. In some cases, property owners may need a full system replacement, but the Health Department will likely allow the property owners to use those new septic systems for an extended period before requiring them to connect to the sewer system.

18. I had heard we were working with Dennis and Harwich on a regional approach. Is that still the case?: The Town of Yarmouth previously explored the possibility of a regional wastewater project by partnering with the towns of Dennis and Harwich. The Town of Yarmouth needed to move forward to take advantage of the most economical opportunities available for the residents to begin environmental restorations. Future phases may involve additional regional discussion.

1. What is a small meter quarterly charge?: It is a charge that all town residents pay quarterly & it helps fund & maintain the mains throughout the town as well as your individual water service.

2. When do I receive my overage bill?: The Town of Yarmouth does not have an overage charge. There are four quarterly charges a year depending on the size of your meter and once a year we read your meter and bill you for consumption.

3. May the homeowner or their plumber remove the water meter for seasonal purposes?: Only the water department personnel may remove or install water meters as prohibited in accordance with Massachusetts General Law Chapter 165 section 11.

4. What should I do if a pipe burst within my home?: Shut the valve off on your side of the meter. If you do not have a shut off valve after the meter then shut the valve off before the meter. This stops the water from entering your household plumbing.

5. What do I do if the pipe before the water meter breaks or leaks?: Call the Yarmouth Water Department office at 508-771-7921.

6. I am a seasonal customer and I do not use my water in the winter. Why do I still receive a bill for a quarterly charge?: Regardless if you use the water or not it is there for your use. Unless, the house is declared vacant, quarterly charges apply. (see: Yarmouth Code 225-26)

7. What should I do if I am selling my home?: If you are selling your home through a real estate agent or privately the water department requires five business days to read the meter to prepare a final bill and transfer from. Also, supply the buyer's name and billing address as shown on the Purchase and Sales Agreement.

8. How do I read my water meter?: The water meter is read from left to right like a car odometer.

9. Is there a way to tell if I have a leak?: After making sure there is no water being used in the house or building, check the water meter for any movement as indicated by the low flow indicator (typically a red triad shaped spinner). If there is any movement of this indicator there is a leak somewhere in your plumbing or fixtures.

10. What if the low flow indicator is moving?

One of the most common leaks, after dripping faucets, is the toilet. Remove the lid from the tank and add a small amount of talcum powder on the water surface. Any movement will indicate a leak. You may also put food coloring in the tank, wait fifteen to twenty minutes and check the toilet bowl. If there is discoloration in the bowl the flap in the tank may need to be cleaned or replaced.

If, your toilet is not leaking you will also need to check all the faucets inside and outside the house.

Don't forget to check your irrigation system by turning off the supply valve to the irrigation system and observing the low flow indicator on the water meter.

11. Is the water department a part of Dig Safe?: No. The water department is not a part of Dig Safe. State laws require anyone who digs to notify utility companies before starting. Digging can be dangerous and costly without knowing where underground facilities are located when requesting a mark out of the water main and service. You must supply the permit number as confirmation.
